Abstract

The interesting question as to whether the Criminal Procedure Act 51 of 1977 provides for surgical intervention in the search for evidence during the course of a criminal investigation received wide media coverage after the decision in (2002 1 SACR 654 (C)). In this case a bullet was lodged in the leg of a robber and the ultimate decision by the Cape high court in favour of allowing for its surgical removal in order to assist the police investigation was generally welcomed by reports in the media as a victory for law enforcement agencies in the seemingly uphill battle against crime.
