In "The American Indian and tribal law: lessons for South Africa" (2003 TSAR 160) and "Aboriginal rights and self determination" (1998 TSAR 788) I emphasised the fact that of all the rights of indigenous peoples, none is more central to their culture than the claim to ancestral lands. This issue remains a contentious one and is also beginning to feature prominently in the sphere of international law.
