In die arbeidsreg is dit egter meer doenbaar as in meeste ander gevalle; onder andere vanweë gespesialiseerde wetgewing wat van toepassing is. In Suid Afrika word die reg tot gelykheid gesien as 'n grondbeginsel van ons nuwe grondwetlike staat. In Le Contrat social (1762) begin Jean-Jacques Rousseau met die volgende woorde: "Man was born free, and he is everywhere in chains" (The Social Contract (2004-Penguin uitg) 2).
It needed to be done. The second edition of Burchell and Milton Principles of Criminal Law (1977) had become outdated due to the recent dramatic developments in the field of criminal law and the corresponding impact of constitutional law developments in the field of criminal law in the past seven years. This third edition of Principles of Criminal Law (2005) is a substantial and comprehensive revision by Burchell of the older second edition, in a work of over 1000 pages, to update the field of criminal law in South Africa effective as on 30 September 2004. Burchell incorporates significant new material that does not only address the South African field of criminal law, but also various aspects and enactments of international criminal law, which makes this work an ideal legal source for research.
This book is the product of a decision taken in 2002 at a meeting of clinical law teachers in Pietermaritzburg, to aim at developing a common curriculum for adoption by all law faculties. The subject matter of the book is the theoretical component of the various legal skills which the course aims to impart. The contributing authors (Bodenstein J; Boniface A; De Klerk W; Haupt F; Kok A; Mahomed SH; Steenhuisen E; Stilwell P en Wimpey D) are all attorneys or advocates and in most instances, teachers of legal skills.
