Abstract

This contribution reflects on employment status and the sufficiency of traditional approaches to determine whether an employment relationship does indeed exist. This it does by investigating these approaches, in particular from the perspective of the work-related status of ministers of religion, judges and magistrates. It therefore, firstly, deals with employment status in labour and constitutional law.


The article, secondly, discusses the status of ministers of religion, highlighting the import of canonical law. It emphasises the impact, from the perspective of South African and comparative case law, of the presence of an intention () to enter into a binding contractual arrangement. Thirdly, the status of judges and magistrates is investigated. This, it is argued, is closely linked to the operation of several overriding principles of a constitutional nature, in particular judicial independence and separation of powers. In the concluding part it is argued that the models or tests historically adopted (in particular the dominant impression test) to determine the real intention of the parties and, therefore, employment status, have to be reserved for those cases where there is no clear legal regime which determines the very nature of the relationship.


In hierdie bydrae word die werkstatus en die toepaslikheid van tradisionele benaderings daartoe bespreek om vas te stel of 'n diensverhouding in gegewe werksverhoudings inderdaad bestaan. Hierdie vraag word ondersoek met spesifieke verwysing na die werksverwante status van predikante, regters en landdroste. In die bydrae bespreek die outeur eerstens die werkstatus in die arbeids- en konstitusionele reg. Tweedens word die status van predikante bespreek en lig die outeur die belang in hierdie verband van die kanonieke reg uit. Die impak van die aanwesigheid van die bedoeling () by alle betrokke partye om 'n bindende kontrak aan te gaan, word beklemtoon. Derdens ondersoek die outeur die status van regters en landdroste. Hierdie status is nou verbonde aan die werking van verskeie grondwetlike beginsels wat van deurslaggewende belang is - veral die beginsels van regterlike onafhanklikheid en skeiding van magte. In die slotgedeelte word voorgestel dat die maatstawwe wat histories aangewend is om te bepaal wat die ware bedoeling van die partye is en of 'n werkstatus aanwesig is, gereserveer moet word vir daardie gevalle waar daar nie 'n duidelike regsregime is wat die aard van die verhouding bepaal nie.
