The National Credit Act 34 of 2005, which has repealed the Usury Act 73 of 1968 and the Credit Agreements Act 75 of 1980, has been enacted in order to regulate consumer credit. It is an evolved piece of legislation which demands to be read in context and mainly aims at affording protection to the man in the street. To this end it contains various novel provisions, such as, for instance, the much publicised provisions on reckless credit and over-indebtedness.
