Abstract

Given the English common law heritage of our procedural system it follows that the admissibility of evidence is a major concern for the parties involved in both civil and criminal proceedings. In typical common law tradition our law of evidence consists mainly of a variety of exclusionary rules, in terms of which certain categories of evidence are excluded. In the present context the focus will fall on the position in civil litigation.
