In the court had the opportunity to decide whether an expropriated owner is entitled to reclaim the expropriated property, should the public purpose for the expropriation not be realised. This note starts with a few introductory remarks on the current expropriation law in South Africa, focusing on the public purpose requirement in particular, before summarising the facts of the case and the judgment. This is followed by a discussion of some of the contentious issues raised in the case.
