According to its preamble, one of the objects of the Prevention of Illegal Eviction from Unlawful Occupation of Land Act 19 of 1998 is to give effect to the constitutional right to housing by regulating the eviction of unlawful occupiers. In order to achieve this object, the act provides that an unlawful occupier may be evicted by a private landowner or person in charge only if, inter alia, the substantive requirements set out in sections 4(6) and 4(7) of the act are satisfied.
