It is often said that law and legal processes respond slowly to change. This is because it is important to foster legal certainty, and it also explains why the law has generally lagged behind the rest of society when it comes to embracing changes resulting from the major technological developments of recent years. However, in the recent case of CMC Woodworking Machinery (Pty) Ltd v Pieter Odendaal Kitchens, the court recognised that technology had evolved drastically since the laws of substituted service were first enacted, and held that as such it "was not unreasonable to expect the law to recognise such changes and accommodate it" (par 2).
