The decision in Lorcom Thirteen (Pty) Ltd v Zurich Insurance Co South Africa Ltd (2013 5 SA 42 (WCC)) is a thoughtful contribution to the debate on insurable interest in the context of property insurance. In this debate two poles are discernible, one conservative and the other liberal or unconventional. The conservatives strive towards upholding the indemnity character of indemnity insurance, while the liberals move away from it. The court dealt extensively with the matter of insurable interest. The eventual decision (by Rogers, J) is beyond critique but not so the court's reasoning and obiter dicta.
