Abstract

The 2 of 2000 (), like all other legislation governing the right of access to information, provides for a number of legitimate grounds for the refusal of information.This article explores these grounds but only as far as they are applicable to public institutions. Part one of the article starts out by explaining the structure of the grounds for refusal and the principles which are crucial to the correct interpretation of the grounds. It then goes on to analyse the first six grounds as contained in the (grounds seven to thirteen are covered in part II). In order to provide a constructive analysis of the specific grounds, corresponding provisions of the American , the Canadian , the New Zealand and the Australian are drawn upon. The wording of the statutory exemptions contained in the legislation of the above-mentioned countries, along with the interpretation given by appeal and review mechanisms, were taken into consideration not only to make proposals regarding the South African situation, but also to enhance understanding of the grounds for refusal as contained in the .

Die 2 van 2000, soos alle ander wetgewing wat die reg op toegang tot inligting reguleer, maak voorsiening vir 'n aantal geldige gronde vir die weiering van inligting. Hierdie gronde is die onderwerp van dié artikel, maar slegs in soverre dit van toepassing is op openbare instellings. In Deel I van die artikel word daar as vertrekpunt ondersoek ingestel na die wyse waarop die weieringsgronde gestruktureer is en na die beginsels wat die interpretasie van die gronde moet rig. Dit word gevolg deur 'n ontleding van die eerste ses weieringsgronde wat in die Inligtingswet vervat is (die oorblywende sewe gronde word in Deel II ontleed). Ten einde die weieringsgronde sinvol te evalueer, is die ooreenstemmende bepalings van die Amerikaanse , die Kanadese , die Nieu-Seelandse en die Australiese geraadpleeg. Die bewoording van die statutêre vrystellings wat in die wetgewing van die voormelde state opgeneem is, tesame met die interpretasie wat deur appèl- en hersieningsmeganismes daaraan geheg is, is in ag geneem om enersyds voorstelle te doen oor die Suid-Afrikaanse situasie en andersyds om meer duidelikheid oor die betekenis en interpretasie van die weieringsgronde vervat in die Inligtingswet, te verkry.
