Abstract


In this article it is argued that the dismissal of Deputy President Jacob Zuma on 14 June 2005 must be understood in the context of the tradition of cabinet responsibility to parliament. It shows how the English tradition of ministerial responsibility is also followed in South Africa. It is argued that President Mbeki affirmed the critical morality of the Constitution that a member of cabinet must sacrifice his / her office when serious charges are brought against such a cabinet member, even if the cabinet member has not had the chance to "have their day" in a court of law. The article argues furthermore that the founding values of the Constitution have not been respected by either Zuma or the National Executive Committee of the ANC by not insisting that Zuma also resigns as Deputy President of the ANC. Public accountability cannot only be required by the Constitution, but must also be respected by institutions of civil society. Mbeki made a strong and visionary decision to dismiss Zuma in June 2005, but the ANC as institution has failed the nation by declining to dismiss Zuma as Deputy President of the ANC - especially after Zuma's evidence in his trial for alleged rape.

In hierdie artikel word aangevoer dat die afdanking van adjunk-president Jacob Zuma op 14 Junie 2005 verstaan moet word binne die konteks en tradisie van kabinets-verantwoordbaarheid aan die parlement. Daar word gewys op die Engelse politieke tradisie wat in Suid-Afrika gevolg is voor en na die oorgang van 1994. Die artikel bevind dat president Mbeki die kritiese moraliteit van die Grondwet bevestig het dat 'n lid van die kabinet sy amp moet neerlê wanneer daar ernstige aanklagte teen hom / haar gemaak word, selfs voordat so 'n persoon sy moontlike onskuld in 'n geregshof kan verdedig. Voorts bevind die ondersoek dat die grondliggende bepalings van die Grondwet met betrekking tot verantwoordingspligtige regering deur sowel Zuma as die Nasionale Algemene Raad van die ANC ondermyn is deurdat Zuma nie ook van sy amp as adjunkpresident van die ANC onthef is nie. Openbare verantwoordingspligtigheid kan nie alleen deur die Grondwet in die streng formele sin bepaal word nie. Mbeki het 'n baie ferm politieke koersaanduidende besluit geneem deur Zuma as adjunkpresident van Suid-Afrika af te dank. Mbeki se handeling op 14 Junie 2005 kan in die politieke geskiedenis van Suid-Afrika as 'n seminale en koersaanduidende gebeurtenis opgeteken word. Die ANC as instelling het egter Suid-Afrikaners in die steek gelaat deur nie vir Zuma as adjunkpresident van die Party af te dank nie - veral nie na sy getuienis in die verkragtingsverhoor nie.
