Abstract

Modern day commerce would be inconceivable without the ability to conclude contracts. Most legal systems today recognise freedom of contract. This means in general that any person of sound mind who is at least 18 years of age, may freely decide if he or she wishes to enter into a particular contract. Such a person may also freely decide whether he wishes to contract with a particular person. The implication of this is that contracts are based on consensus.
