Abstract

Marriage is by customary rite a polygamous or potentially polygamous union between man and woman. Today it is unlawful for a man married by customary rite to remarry during the subsistence of his marriage except under certain circumstances. Where a man has been married by customary rite for more than ten years and his wife has not given birth to a child, the man is entitled to remarry, although he is not entitled to divorce his first wife. In remarrying he may adopt one of two courses.
