Abstract

Over the past ten years South Africa has made considerable progress in the constitutional sphere. Indeed, today its Constitution is one of the most modem and progressive in the world. In this article the author examines the provisions of the Bill of Rights in the light of some of the cases that would probably have had a different outcome had they arisen under South Afnca's previous system of parliamentary supremacy.
