Abstract

Arising from a Judgment delivered a few months ago in the Transvaal, it has become necessary to set out briefly under what circumstances a legal representative of an accused person or litigant is entitled to interview a witness who may be called either by the State or by the other party. In the aforementioned Judgment the following was said - ""In 'n siviele geding is daar reëls en die partye speel die spel volgens daardie reëls met die Regter as arbiter en hy moet dan besluit op die getuienis wat voor hom geplaas word deur die partye.
