Abstract

The elimination of bribery and corruption is one of the most formidable challenges facing the private and public sectors, not only in South Africa, but globally. Alarmingly, many business executives still have the misperception that bribery and corruption do not impact on their organisations and that they do not need to concern themselves with managing this type of risk. There is also an all pervasive culture in South Africa to offer and accept lavish entertainment and/or gifts in the ordinary course of business. For organisations to manage this risk, executives are required to understand and identify their potential exposure and be aware of the bribery and corruption legislation that may impact on their businesses. In particular, South African organisations operating in jurisdictions other than South Africa, or which conduct business with foreign organisations or governments, also need to familiarise themselves with the bribery and corruption legislation of those jurisdictions.
