Abstract

With Africa fast becoming the continent of opportunity for business and South Africa often considered the gateway for foreign investment into the continent, contracting parties may freely choose the governing law to apply to their contractual relations. It doesn't follow, though, that South African courts may necessarily be ousted where South African law would otherwise have applied.
