The Labour Court recently had to determine whether there had been a transfer of a business as a going concern, in terms of s197 of the Labour Relations Act (the LRA), in circumstances where the old service provider used assets and equipment primarily provided by the client and utilised employees employed by a separate entity in the Group to perform the service for the client.
