Woe the poor employer : Armageddon is certainly upon us. When a company cannot even successfully defend the dismissal of a security guard where the errant employee fails to do something as fundamental as searching workers leaving the premises, the end must be nigh. This must be doubly so where these employees are potentially smuggling out tonnes of platinum in their shoes, lunch boxes and in secret compartments in their cell phones. Industry leaders are probably choking on their gins & tonics while lamenting the seemingly ever-increasing reach and probe of the arm of the law. There is increasing concern that employers can expect little sympathy from the courts on employment matters.
