Abstract

On September 20 2007 the Appeal Courtl unanimously dismissed the appellants' appeal against a High Court decision (Van Zyl v Government of RSA TPD (Case No 20320/2002)), closing another chapter in the 18-year old dispute between van Zyl and the Lesotho and South African governments. The dispute relates to the cancellation by Lesotho, in 1991, of five mining leases, which covered areas within the basin of the Khatse Dam. The lease areas had to be flooded in order to build the dam, which formed part of the World Bank-financed Lesotho Highlands Water Project.
