Abstract

How wide should the regulatory net be cast? An integral part of merger regulation is striking the right balance to ensure potentially anti-competitive transactions are scrutinised by the competition authorities, without them being over-burdened by too many non-problematic transactions. This issue is of great importance, especially in countries such as South Africa, where the implementation of mergers without approval from the competition authorities is prohibited.
