Abstract

The negligence required to establish liability in delictual actions is determined by the standard of care and skill observed by the reasonable person in similar circumstances - the reasonable person test. This standard is decided on the facts peculiar to each case. A category of cases that often give rise to difficulties are the result of night driving and collisions with unobserved obstructions.
