The judges say
In the recent judgment of S A Police Service v Magwaxasa 2019 ZALAC 66, handed down on 5 November 2019, the Labour Appeal Court had to pronounce on the fairness of the dismissal of a member of the South African Police Service (SAPS) who was subject to a disciplinary hearing, following the fatal shooting, while off duty, of a member of the public. The facts that gave rise to the matter at hand can briefly be summarised as follows: The SAPS member was off duty on 24 December 2011 when he attended a traditional ceremony in his local community. At the ceremony he got involved in an argument with the deceased over the spillage of traditional beer at another function the previous day.
