When parents decide to separate or are in the process of getting a divorce they often fight and battle their differences. They are often of the opinion that they are fighting for their children in deciding who will have custody, but ironically children are often overlooked during this battle. Parents act on emotion which is clouded by their animosity towards each other without considering the safeguarding and protection of their children's best interests. When parents cannot agree about primary custody, it is time for the family advocate to step in. Custody affects the child much more than his or her parents. It is therefore necessary for the court, as the upper guardian of the minor child, to decide which parental plan or arrangement is most suitable and promotes the best interests of the minor child in the circumstances. In reaching its decision the court is guided by, among other things, a recommendation made by the Office of the Family Advocate (Mngomezulu, 2019).
