Abstract

The Intellectual Property Rights from Publicly Financed Research Bill ('the Bill') proposes to define the rights of the 'State in Intellectual Property derived from Publicly Financed Research' (the long title of the Bill). In particular, the Bill proposes () to introduce a first ownership rule in respect of Publicly Financed Research; () to create a new government bureaucracy headed by the centralized National Intellectual Property Management Office; () to impose wide-ranging disclosure obligations on Publicly Financed Institutions; () to provide for benefit sharing between inventors and Publicly Financed Institutions; and () to create 'walk-in' rights for the State.
