Abstract

Section 2 of the Magistrates' Court Act 32 of 1944 provides that the minister of justice and constitutional development may, by notice in the , create districts and regional divisions (consisting of a number of districts) and establish a court for any district and regional division for the purpose of the trial of persons accused of committing any offence. These courts are referred to as magistrate's courts (or district courts) and regional courts respectively and together form the lower court component of the South African court system.
