Abstract

Legal pluralism within a South African context reflects the realities and complexities of a diverse society and the impact it has on a legal system. According to Rautenbach the fibre of the South African society remains splintered along cultural and religious lines and is symbolized in the legal system (Rautenbach "Deep legal pluralism in South Africa: judicial accommodation of non-state law" 2010 143). Members of cultural and religious communities observe certain aspects of their own "laws" but these "laws" are not generally recognized by the South African state law.
