Abstract

The readers of this journal will already be familiar with earlier editions of this excellent work now in its third edition. The first, published by Chief Justice Rabie in 1992, was an expanded version of the entry that he had written on "Estoppel" for , and it quickly established itself as the standard reference point for research on this difficult topic. Its sustained and principled analysis did much to dispel any notion of estoppel as "a sort of joker or wild card to be used whenever the court disapproves of the conduct of a litigant who seems to have the law on his side" (p 41 of 3rd ed, quoting Lord Walker of Gestingthorpe in 2008 4 All ER 713 (HL) 737 par 46). In 2000 a significantly longer second edition was published by Prof Sonnekus, but since that time, the case law involving estoppel has continued to develop, and with it the commentary.
