By Anashri Pillay Public Law Department, UCT The applicants approached the Cape Provincial Division of the High Court asking that the magistrate's decision not to recuse himself from a matter be reviewed and set aside. The matter was a criminal one, dealing with a contravention of the Drugs and Drugs Trafficking Act 140 of 1992. The magistrate, who was later to act as presiding officer in the trial, had issued two search warrants during the investigation of the case.
